For all customers
- We’ll never share your information for advertising or marketing purposes.
- You may not send spam, abuse the Internet, or use our services to break the law.
- You’re responsible for the actions of others with whom you share access to our services.
- Please keep reading for more details.
Parties & definitions
- Sandwich Internet Corp. (“Sandwich”) is a Canadian federal corporation.
- “Service” is any service or resource that Sandwich provides to our customers.
- The “TOS” (Terms of Service) is this document.
Contract, jurisdiction & venue
By using the Service, you agree to the TOS, which is a contract between us.
We may change the TOS. When we do, we’ll announce the changes here at least 30 days before they take effect. We’ll also make a reasonable effort to email the announcement to current customers.
If any portion of the TOS is deemed invalid, the rest remains in effect. The TOS’ section headings are just for easy reading; they don’t change its meaning.
The laws, jurisdiction, and venue of Vancouver, British Columbia, Canada govern any disputes over the Service, including the TOS’ interpretation or application.
As part of processing your payments, we may share your contact and service information with our payment processors and fraud screening services.
If we or substantially all of our assets are acquired, we may transfer your information to our acquirer under terms requiring them to handle it at least as restrictively as the TOS requires of us.
We won’t disclose your contact or service information to any other third party unless:
- We’ve obtained your prior, explicit, written consent; or
- Such disclosure is required by our domain name registration terms; or
- Such disclosure is permitted by the TOS due to illegal use of the Service; or
- Disclosure is required by law.
We’ll immediately notify you of any coerced disclosure of your contact or service information, if permitted by law.
If we believe that your information may have been breached, we’ll notify you immediately, unless that would interfere with law enforcement’s investigation of the breach.
Information stored, transmitted, or otherwise made available using the Service isn’t private in an absolute sense: our staff may see it during the normal course of providing technical support or monitoring the Service’s security. All our staff act with the utmost respect for your privacy, following the USENIX System Administrators’ Code of Ethics.
You may not use the Service to commit, aid, or abet any activity that’s illegal under Canadian law. If you do, we may terminate your access to the Service. We may disclose your contact and service information to law enforcement authorities in cases of computer or network intrusion, fraud, harassment, non-consensual pornography, or violent crimes.
Unsolicited bulk email
You may not use the Service to send unsolicited bulk email (“spam”). If you do, we’ll terminate your access to the Service and you’ll owe us liquidated damages of $50.00 (USD) per message sent, up to a maximum of $25,000.00 (USD) per day.
If you use the Service in the content of any spam message (e.g. as an email address or Web site mentioned in a spam message), but not directly in the sending of that message, we’ll terminate your access to the Service and you’ll owe us liquidated damages of $250.00 (USD).
These damages compensate us for our investigatory efforts and for the likely disruption of our and our other customers’ ability to send email, which are infeasible to calculate in advance.
Computer & network abuse
You may not use the Service to:
- Probe or penetrate the security of any Internet site, except as that site has explicitly authorized; or
- Elevate your access privileges on any Internet site beyond those authorized; or
- Attempt the above activities.
If you do, we’ll terminate your access to the Service, and we may disclose your contact and service information to law enforcement authorities.
You may not use the Service to transmit, store, or otherwise make available security exploitation, system/network scanning, or Denial of Service tools, except as incidental to following information security media like mailing lists. If you do, we’ll terminate your access to the Service.
If you’re engaged in legitimate security research, penetration testing, or responsible vulnerability disclosure, and you would like to discuss a more detailed waiver, please contact us.
Content restrictions & liability
You may not use the Service to transmit, or otherwise make available, content that’s illegal under Canadian law, or is, in our reasonable inference, intended to harass, intimidate, threaten, or promote hatred against an individual or group. We recognize that many forms of criticism aren’t harassment.
By using the Service, you agree to indemnify us from liability relating to any information that you transmit, store, receive, or otherwise make available using the Service, including reasonable attorney’s fees we or our agents incur in defending legal, arbitration, regulatory, administrative, or similar investigations or actions.
Sharing your access
If you share your access to the Service with another individual or organization, you’re responsible for their use of the Service and compliance with the TOS. If you discover that your access to the Service is being used without your authorization, you must report the incident to us immediately.
Payments and refunds
If your cheque is returned to our bank unpaid, you’ll owe us our bank’s related fees, which are currently $7.50 (CAD) per instance.
Most of our services are non-refundable. Please see below for our shared Web hosting service’s 30-day satisfaction guarantee.
We reserve the right to terminate (cease providing) the Service at any time, and for any reason. If we terminate the Service for any reason other than violation of the TOS, we’ll refund you for the portion of the Service that won’t be used. (For example, if you paid for a month of service and we terminate service five days before the paid period ends, we’ll refund you for the remaining five days.)
Any damages whatsoever (including without limitation emotional damages, business interruption, or loss of business profits) arising from Service termination, malfunction, or any other inability to use the Service are limited to, at maximum, the actual amount you paid us. If you violated the TOS, we won’t be liable for any damages of any kind.
For Web hosting customers
You may not use our shared Web hosting service to run programs on our equipment, except for the purpose of processing standard Web and email requests. We can’t routinely allow resident/daemon applications, like game servers or IRC robots, on this service. Please contact us to discuss exceptions.
If you’re dissatisfied with our shared Web hosting service for any reason, you may request and receive a full refund within the first 30 days after the Service is activated. Domain name registrations aren’t refundable. After the first 30 days of service, refunds are at our discretion.
For domain name registration customers
We’re a reseller of Tucows OpenSRS’ registrar services.
- The additional terms for domain names.
- ICANN’s Registrant Educational Materials.
- ICANN’s Registrant Benefits & Responsibilities.
DNSSEC fees do not apply in most cases. Please contact us for more details.
Expiration & renewal
Our domain name registration and renewal fees are available on our main domain name registration page.
About 60 days before your domain name expires:
- If you’ve asked us to automatically charge a credit or debit card, we’ll renew it and charge you.
- Otherwise, we’ll send you an invoice for the renewal.
We’ll email you more reminders 30 days and 5 days before your domain name expires, and then 3 days after it expires.
Sadly, we have to pass along registries’ higher fees if you need to “redeem” a domain name that’s been expired longer than the grace period, but is within the redemption period. This fee is in addition to the renewal cost.
|Top Level Domain||Redemption (USD)|

- The availability of a redemption period is not guaranteed.
